Terms of Service

By booking photography services with Olesia Batura Photography, you agree to these terms:

• Services are provided as professional photography sessions
• All bookings require signed contract and deposit
• Session details are confirmed via email communication
• Changes to bookings require 48-hour notice
• Final payment due 48 hours before session date

Deposits and Payment:

• Non-refundable deposit of 30% required to secure booking
• Remaining balance due 48 hours before session
• Accepted payment methods: Credit card, bank transfer, PayPal
• Late payment may result in session cancellation

Cancellation Policy:

• Client cancellations require 48-hour notice
• Deposits are non-refundable but may be transferred to new date
• Weather-related cancellations will be rescheduled at no charge
• Photographer cancellations result in full refund

Photo Delivery:

• Photos delivered within 7-10 business days via online gallery
• Gallery access provided for 6 months from delivery date
• High-resolution download included with all packages
• Print release provided for personal use

Usage Rights:

• Client receives full personal usage rights
• Commercial usage requires separate licensing agreement
• Photographer retains copyright and portfolio usage rights
• Social media sharing encouraged with photographer credit

Portfolio Usage:

• Photographer may use session photos for marketing and portfolio
• Client consent requested before public display
• Opt-out available at any time by written request
• Sensitive or private photos excluded from marketing use

Client Responsibilities:

• Arrive on time for scheduled sessions
• Notify photographer of special requirements in advance
• Ensure children and participants are cooperative
• Respect photographer's time and equipment

Session Guidelines:

• Sessions may be rescheduled due to weather or safety concerns
• Additional time beyond package limits charged hourly
• Location fees and permits are client responsibility
• Travel fees apply for sessions outside Toronto area

• Gallery access is private and secured with unique login
• Access credentials should not be shared publicly
• Download attempts are logged for security purposes
• Galleries expire after 6 months unless extended
• Gallery extension available for additional fee
• Abuse of gallery system may result in access termination

• Photographer liability limited to amount paid for services
• Equipment failure or unforeseen circumstances may affect delivery
• Backup equipment and procedures minimize service disruption
• Force majeure events (natural disasters, emergencies) may void contract
• Client responsible for backup of downloaded photos
• No liability for loss or damage during photo shoots

Copyright and intellectual property rights:

• Photographer retains copyright to all images
• Client receives usage license, not ownership
• Unauthorized reproduction or distribution prohibited
• Credit to photographer required for professional use
• Editing or altering photos without permission forbidden

In case of disputes:

• Good faith negotiation attempted first
• Mediation through professional photography associations
• Binding arbitration if mediation fails
• Ontario law governs all agreements
• Toronto courts have exclusive jurisdiction
